Interview with H Abdur Raqeeb, Convener, National Committee on Islamic Banking

Islamic Banking has been a hot topic in India for the last few months. The debate on whether Islamic Banking is permissible in India has a lot of dimensions. In an interview withPramod Thomas, H Abdur Raqeeb, Convener, National Committee on Islamic Banking, points out the benefits of Islamic Banking to the deprived class. Abdur Raqeeb, who is also the General Secretary of Indian Center for Islamic Finance (ICIF), here describes what really Islamic Banking means.
How do you perceive the recent Kerala High Court order regarding Islamic banking?
First of all, I wish to clarify that the recent verdict of the High Court of Kerala was not on Islamic banking but for the participation or rather having a share of 11% in an NBFC-Non Banking Financial company- based on Shariah principles by State of Kerala or its agencies like Kerala State Industrial Development Co-KSIDC.
Dr Subramaniam Swamy's argument was that being a secular country, Kerala government cannot take part or promote an Islamic Financial Company and it was as if promoting the Islamic religion or propagating the religion which is against the secular edifice of the Indian constitution.
Again Kerala government cannot spend tax payers money on such ventures according to the article 27 of Indian constitution.
The verdict is significant in the sense that for the first time the court has ruled that it is not against secular concept of the Indian constitution to promote religion based finance like shariah-(Islamic principles of finance and business) based companies and regulates them.
This is a significant and historic judgment and in future will lead to Islamic banking in our great country along with conventional banking.
This is just like a non-vegetable hotel having and allowing a separate section for vegetarians as well. Now there is a scope that the GOI will allow both the conventional finance based on interest and Islamic finance and banking which is interest free
What is the future of Islamic banking in India?
The future is very bright for Islamic banking in India. Sixty percent people of the country are not covered by the conventional banking and most of them are marginalized and the minorities.
Small farmers, skilled laborers, petty traders do not have collateral and not credit worthy as per banking system and minorities like Muslims are excluded because of interest based banking which is strictly prohibited in their faith.
If an alternate system which is interest free and ethical and provides a platform for the marginalized, this is going to be a big boost for this Islamic banking.
Planning Commission of India constituted a high level committee on Financial Sector Reform in 2008 headed by Dr RaghuRam Rajan, former IMF Chief Economist and some of the outstanding bankers and legal experts of India and this committee, CFSR, recommended that Interest free banking to be included in the main banking system of India for" inclusive growth with innovation."
In simple terms what is Islamic banking and how it can be beneficial for common man?
Some of the salient features of Islamic banking are as follows:
It is interest free
It is based on profit and loss sharing concept- risk and reward in most of the venture
Against any speculative trade like futures, derivatives etc
Against investment on unethical projects like liquor, gambling, pornography, weapon of mass destruction, environmental hazards etc.
Investment on real economy and asset based and not engaged on financial engineering which is money being traded against money.
Is the term Islamic the main obstacle for the popularity of Islamic banking, If so how can you convince others?
To a certain extent, the word Islamic is misunderstood by a large segment of the people and this is also due to misinformation by the media which parrots blindly the western propaganda.
Islamic finance and banking is therefore named as alternative banking in Britain, participatory banking in Turkey, interest free banking in some countries like Nigeria.
Any name is possible but the principles of Shariah are to be followed to a large extent which is ethical and socially responsible.
Another misconception is that Islamic finance and banking is for Muslims only. This is not true. In Malaysia, forty percent customers in Islamic banks are non Muslims and in Britain twenty percent customers are non-Muslims.
Further, secular modern and industrialized countries where Muslim population is not large, like Britain, France, Hong Kong and Singapore, the regulators have accommodated Islamic finance and banking and allowed a level playing field along with the conventional banking.
If London, Paris, Zurich, Singapore and Hong Kong can become hub and house of Islamic finance and banking, why not Mumbai and Cochin?
How a business man will get assistance from Islamic banking for fund raising?
According to Dr Hussein Hamid Hassan, Chairman, Shariah Board, Dubai Islamic Bank, Conventional banks have only one product whatever their name or product may be, they are based on interest, but Islamic Banks have product what each customer, every project and every circumstance tailor made like, Mudharaba, musharaka, Ijara, Sukuk, Takaful, Qard Hasna etc.

The Mayonnaise Jar
When things in your life seem, almost too much to handle,
When 24 Hours in a day is not enough,
Remember the mayonnaise jar and 2 cups of coffee.
A professor stood before his philosophy class
and had some items in front of him.
When the class began, wordlessly,
He picked up a very large and empty mayonnaise jar
And proceeded to fill it with golf balls.
He then asked the students, if the jar was full.
They agreed that it was.
The professor then picked up a box of pebbles and poured
them into the jar. He shook the jar lightly.
The pebbles rolled into the open Areas between the golf balls.
He then asked the students again if the jar was full. They agreed it was.
The professor next picked up a box of sand and poured it into the jar.
Of course, the sand filled up everything else.
He asked once more if the jar was full. The students responded with a unanimous 'yes.'
The professor then produced two cups of coffee from under the table and poured the entire contents into the jar, effectively
filling the empty space between the sand. The students laughed.
'Now,' said the professor, as the laughter subsided,
'I want you to recognize that this jar represents your life.
The golf balls are the important things - family,
children, health, Friends, and Favorite passions –
Things that if everything else was lost and only they remained, Your life would still be full.
The pebbles are the other things that matter like your job, house, and car.
The sand is everything else --The small stuff.
'If you put the sand into the jar first,' He continued,
there is no room for the pebbles or the golf balls.
The same goes for life.
If you spend all your time and energy on the small stuff,
You will never have room for the things that are important to you.
So...
Pay attention to the things that are critical to your happiness.
Play With your children.
Take time to get medical checkups.
Take your partner out to dinner.
There will always be time to clean the house and fix the disposal.
'Take care of the golf balls first --
The things that really matter.
Set your priorities. The rest is just sand.'
One of the students raised her hand and inquired what the coffee represented.
The professor smiled.
'I'm glad you asked'.
It just goes to show you that no matter how full your life may seem,
there's always room for a couple of cups of coffee with a friend.'

ஆம் சகோதரர்களே ! இனிமேல் நமக்கோ அல்லது நமது பிள்ளைகளுக்கோ நர்சரி தேவையில்லை?!, ஸ்கூல் தேவை இல்லை?!, காலேஜ் தேவையில்லை?! யூனிவர்சிடியும் தேவையில்லை?! இவையெல்லாம் தேவையில்லை என்றாகி விட்டால் ஆசிரியர்களுக்கும், ப்ரோபசர்களுக்கும் நமக்கு தேவையிருக்காது. இதற்கெல்லாம் எங்கே நேரம் இருக்கிறது ?இந்த அவசர காலத்தில் தேவையான புத்தகங்களை கிடைக்கும் இடங்களில் வாங்கி, தேவைப்படும் போதும் நேரம் கிடைக்கும் போதும் வீட்டிலேயே படித்து புரிந்து கொள்ளலாம்?! சகோதரர்களே மேலும் இருக்கவே இருக்கிறது இன்டர்நெட் , கம்ப்யூட்டர் இது போன்ற இன்றைய அதிநவீன தொடர்பு சாதனம் மூலமாகவும் நாம் படித்தும் அறிந்தும் நம் அறிவை வளர்த்துக் கொள்ளலாம் பின்னர் இந்த அறிவுக்கு ஏற்றமாதிரி வேலைக்கும் சேர்ந்து கொண்டு பணமும் சம்பாதித்துக் கொள்ளலாம். இன்று நாம் வாழ்ந்து கொண்டிருக்கும் கால சூழ்நிலைகளில் பணம் சம்பாதிக்க வேண்டும், சந்தோஷத்துடன் வாழ வேண்டும் , செலவழிக்க வேண்டும் அனுபவிக்க வேண்டும் இதை விட்டு விட்டு ஸ்கூல், காலேஜ் , ஆசிரியர் என்றெல்லாம் எதற்கு ? ....... அன்பான சகோதரர்களே ! இப்படி நம்மில் யாராவது நினைக்கவோ அல்லது செயல்படவோ முடியுமா?..... முடியும் என்கிறார்கள் அல்லது எண்ணுகிறார்கள் பெரும்பான்மையான நம் முஸ்லிம் சமுதாய மக்கள் ??? ஆச்சரியமாக இருக்கிறதா ? ஆம் சகோதரர்களே இது தான் இன்றைய உண்மையான நிலவரம்.
இனி விஷயத்திற்கு வருகிறேன்... முடியும் என்று சொல்லுகிற நம் முஸ்லிம் மக்களை நான் காரணத்துடன் இங்கே எதிர்மறையாகவே குறிப்பிட்டு சொல்லியிருக்கிறேன் . அதாவது உலக கல்வி விஷயத்தில் மேலே குறிப்பிட்டிருக்கும் செயல்களை நினைக்கவும் செய்யவும் முடியாது என்று சொல்லுகிறவர்கள் தீன் கல்வி விஷயத்தில் முடியும் என்று சொல்லுகிறார்களே அல்லது நினைத்து செயல்படுகிறார்களே ?! இது மட்டும் எப்படி ?சகோதரர்களே ! தீன் கல்விக்கு செயல்படுகிற மாதிரிதானே உலக கல்விக்கும் செயல்படவேண்டும்?பின் ஏன் நமக்கு இந்த இரட்டை நிலை ? இதற்கு காரணமும் ரொம்ப சிம்பிள். அதாவது உலக கல்வி அறிவுக்காக பெறுகிறோம் என்றாலும், பணமும், அதனால் கிடைக்கக் கூடிய வசதியும், வாய்ப்பும், புகழும் , நிம்மதியும் , சந்தோஷமும் , நமது வாழ்வில் மிகவும் முக்கியமானது என்று மிக சரியாகவே உணர்ந்துள்ளோம் ஆகையால் இதற்காக, இந்த கல்விக்காக நாம் அவரவர் நிதி நிலையை பொறுத்தும் , சில சமயம் வட்டிக்கு பணம் பாங்கிலிருந்து வாங்கியும் என்ன விலை கொடுத்தாவது இந்த உலக கல்வியை பெற்றுக் கொண்டு எதோ ஒரு நிம்மதியில் வாழ்கிறோம். ஆனால் சகோதரர்களே தீன் கல்வி விஷயத்தில் நமக்கு உலக கல்வி விஷயம் போல தீன் கல்வி நமது வாழ்க்கைக்கு அந்த அளவுக்கு மிகவும் முக்கியமானது அல்ல என்பதை பெரும்பாலான முஸ்லிம் எண்ணம் கொண்டுள்ளதால்தானே இந்த தீன் கல்வியில் மக்கள் மிகவும் பின்தங்கியுள்ளார்கள்.
ஒரு உண்மையான முஸ்லிம் அல் குர்ஆனையும், ரசூல் (ஸல்) அவர்களின் வழிமுறையையும் கற்றுதானே ஆகவேண்டும் அப்பொழுதானே வாழ்க்கையில் நாம் இஸ்லாமை பின்பற்ற முடியும் இதில் சந்கேகம் கொள்ளமுடியுமா ? தீன் கல்வி நமது வாழ்க்கைக்கு கண்டிப்பாக தேவை என நாம் உண்மையிலேயே உணர்ந்துள்ளோமா ?அப்படி நாம் உணர்ந்திருந்தால் இந்த தீன் கல்வியை பெறுவதில் இத்தனை அலட்சியம் நம்மில் வருமா ? குர்ஆனை பற்றியும் இதனை முறையாக அறிந்து கொள்ளாமல் இருப்பவர்களை பற்றியும் அல்லாஹ் ரப்புல் ஆலமீன் என்ன சொல்கிறான் என்பதை.......................................................................................

இது என்ன தலைப்பு?! என்று படித்துக் கொண்டிருக்கிற நீங்கள் ஆச்சரியப்படுவது இயல்புதான்.ஒரு சில உண்மை சூழ்நிலைகளை விழிப்புணர்வுக்காக இப்படி தலைப்பிட்டு எழுதுவது இன்றைய காலத்தின் கட்டாயம்.

இனி விஷயத்திற்கு வருகிறேன்... முடியும் என்று சொல்லுகிற நம் முஸ்லிம் மக்களை நான் காரணத்துடன் இங்கே எதிர்மறையாகவே குறிப்பிட்டு சொல்லியிருக்கிறேன் . அதாவது உலக கல்வி விஷயத்தில் மேலே குறிப்பிட்டிருக்கும் செயல்களை நினைக்கவும் செய்யவும் முடியாது என்று சொல்லுகிறவர்கள் தீன் கல்வி விஷயத்தில் முடியும் என்று சொல்லுகிறார்களே அல்லது நினைத்து செயல்படுகிறார்களே ?! இது மட்டும் எப்படி ?சகோதரர்களே ! தீன் கல்விக்கு செயல்படுகிற மாதிரிதானே உலக கல்விக்கும் செயல்படவேண்டும்?பின் ஏன் நமக்கு இந்த இரட்டை நிலை ? இதற்கு காரணமும் ரொம்ப சிம்பிள். அதாவது உலக கல்வி அறிவுக்காக பெறுகிறோம் என்றாலும், பணமும், அதனால் கிடைக்கக் கூடிய வசதியும், வாய்ப்பும், புகழும் , நிம்மதியும் , சந்தோஷமும் , நமது வாழ்வில் மிகவும் முக்கியமானது என்று மிக சரியாகவே உணர்ந்துள்ளோம் ஆகையால் இதற்காக, இந்த கல்விக்காக நாம் அவரவர் நிதி நிலையை பொறுத்தும் , சில சமயம் வட்டிக்கு பணம் பாங்கிலிருந்து வாங்கியும் என்ன விலை கொடுத்தாவது இந்த உலக கல்வியை பெற்றுக் கொண்டு எதோ ஒரு நிம்மதியில் வாழ்கிறோம். ஆனால் சகோதரர்களே தீன் கல்வி விஷயத்தில் நமக்கு உலக கல்வி விஷயம் போல தீன் கல்வி நமது வாழ்க்கைக்கு அந்த அளவுக்கு மிகவும் முக்கியமானது அல்ல என்பதை பெரும்பாலான முஸ்லிம் எண்ணம் கொண்டுள்ளதால்தானே இந்த தீன் கல்வியில் மக்கள் மிகவும் பின்தங்கியுள்ளார்கள்.
ஒரு உண்மையான முஸ்லிம் அல் குர்ஆனையும், ரசூல் (ஸல்) அவர்களின் வழிமுறையையும் கற்றுதானே ஆகவேண்டும் அப்பொழுதானே வாழ்க்கையில் நாம் இஸ்லாமை பின்பற்ற முடியும் இதில் சந்கேகம் கொள்ளமுடியுமா ? தீன் கல்வி நமது வாழ்க்கைக்கு கண்டிப்பாக தேவை என நாம் உண்மையிலேயே உணர்ந்துள்ளோமா ?அப்படி நாம் உணர்ந்திருந்தால் இந்த தீன் கல்வியை பெறுவதில் இத்தனை அலட்சியம் நம்மில் வருமா ? குர்ஆனை பற்றியும் இதனை முறையாக அறிந்து கொள்ளாமல் இருப்பவர்களை பற்றியும் அல்லாஹ் ரப்புல் ஆலமீன் என்ன சொல்கிறான் என்பதை.......................................................................................

புதுடெல்லி,பிப்.5:2002 ஆம் ஆண்டு குஜராத் முஸ்லிம் இனப் படுகொலையில் அம்மாநில முதல்வர் நரேந்திர மோடிக்கு தெளிவான பங்கிருப்பதாக உச்சநீதிமன்றத்தால் நியமிக்கப்பட்ட சிறப்பு புலனாய்வுக் குழு (SIT) கண்டறிந்துள்ளது. பாரபட்சமாக நடந்துக் கொண்டும், நடவடிக்கைகள் மேற்கொள்ளாமலும், பாதிக்கப்பட்டவர்களை புறக்கணித்தும் கலவரத்திற்கு உதவியதாக மோடி மீது குற்றஞ்சாட்டி எஸ்.ஐ.டி தனது அறிக்கையில் கூறியுள்ளது.
2010 ஆம் ஆண்டு மே மாதம் 12-ஆம் தேதி விசாரணையை பூர்த்திச் செய்து முத்திரை வைக்கப்பட்ட உறையில் வைத்து உச்சநீதிமன்றத்தில் எஸ்.ஐ.டி சமர்ப்பித்த அறிக்கையை டெஹல்கா பத்திரிகை வெளியிட்டுள்ளது. இனப்படுகொலையை தடுத்து நிறுத்துவதிலும், வகுப்புவெறியை தூண்டிவிட்ட பத்திரிகைகளுக்கு எதிராக நடவடிக்கை எடுப்பதிலும் மோடி தோல்வியடைந்தார் என அவ்வறிக்கை கூறுகிறது.
சட்டமன்ற தேர்தலுக்கு முன்னோடியாக 2002 ஆம் ஆண்டு ஆகஸ்ட் மாதம் மாநிலத்தில் சட்ட-ஒழுங்கு பிரச்சனை திருப்தியாக உள்ளதாக குஜராத் அரசு தவறான அறிக்கை வெளியிட்டதையும் இவ்வறிக்கை சுட்டிக் காட்டுகிறது. மோடியை குற்றமற்றவராக்கி எஸ்.ஐ.டி அறிக்கையை தாக்கல் செய்துள்ளதாக ஏற்கனவே செய்திகள் வெளியாகியிருந்தன. மோடியின் மீதான நம்பிக்கையை தகர்ப்பதற்கான முயற்சிகளுக்கு கிடைத்த பதிலடி இவ்வறிக்கை என அப்பொழுது அத்வானி உள்ளிட்ட பா.ஜ.க தலைவர்கள் கருத்துத் தெரிவித்திருந்தனர்.
பா.ஜ.கவின் எதிர்பார்ப்புகளுக்கு கடுமையான பதிலடி தரும்விதத்தில் முஸ்லிம் இனப்படுகொலையில் மோடியின் பங்கைக் குறித்து எஸ்.ஐ.டியின் அறிக்கை விரிவாக கூறுகிறது. வகுப்புவாத சிந்தனையோடு செயல்பட்டார், உணர்ச்சியைத் தூண்டும் உரைகளை நிகழ்த்தினார், முக்கியமான ஆதாரங்களை அழித்தார், சங்க்பரிவார உறுப்பினர்களை அரசு தரப்பு வழக்கறிஞராக நியமித்தார், பாதிக்கப்பட்டவர்களுக்கு நீதியை மறுத்தார், இனப்படுகொலை நிகழும் வேளையில் போலீஸ் கட்டுப்பாட்டு அறைகளில் சட்ட விரோதமாக அமைச்சர்களை நியமித்தார். பாரபட்சமின்றி நடந்துக் கொண்ட அதிகாரிகளை தொந்தரவுச் செய்தார் ஆகிய காரியங்களில் மோடி குற்றவாளி என எஸ்.ஐ.டியின் அறிக்கை தெளிவுப்படுத்துகிறது.அரசுத்துறைகள் ஒன்று செயலிழந்து போனது அல்லது கலவரத்தை மேலும் கொளுந்து விட்டெரியும் விதத்தில் செயல்பட்டது என அறிக்கை விரிவாக கூறுகிறது. தீங்கு விளைவிக்கக்கூடிய, குற்றகரமான விமர்சனங்களை முஸ்லிம்களுக்கு எதிராக தெரிவித்த மோடி உயர்ந்த பதவியிலிருந்துக் கொண்டு சிந்தனையற்ற பொறுப்பற்ற முறையில் நடந்துக் கொண்டார் என எஸ்.ஐ.டியின் அறிக்கை கூறுகிறது.
எஸ்.ஐ.டியின் அறிக்கையில் முக்கிய பகுதிகள்:
1.குல்பர்க் சொசைட்டி, நரோடா பாட்டியா உள்பட மாநிலம் முழுவதும் முஸ்லிம்கள் கொடூரமாக தாக்கப்பட்ட பொழுது யாரும் எதிர்பார்க்காத வகையில் முதல்வரும், அரசும் நடந்துக் கொண்டது. எல்லா வினைகளுக்கும் எதிர்வினைகள் உண்டு என்று கூறி முஸ்லிம்களுக் கெதிரான கலவரத்தை நியாயப்படுத்தினார் மோடி. கோத்ராவிலும், அதன் சுற்று வட்டாரங்களிலும் குற்ற வாசனையுடையவர்கள் இருக்கின்றார்கள் என மோடி குற்றஞ்சாட்டியது ஹிந்து-முஸ்லிம் பிரிவினரிடையே மேலும் உணர்ச்சியை தூண்டிவிட்டது.
2.அசோக் பட், ஐ.கே.ஜடேஜா ஆகிய அமைச்சர்களை அஹமதாபாத் நகர போலீஸ் கட்டுப்பாட்டு அறையிலும், மாநில போலீஸ் கட்டுப்பாட்டு அறையிலும் நியமித்தார். இனப்படுகொலை நடைபெறும் பொழுது போலீஸ் நடவடிக்கைகளை இவர்கள் சீர்குலைத்ததற்கு காரணம் உள்துறை அமைச்சகத்தின் பொறுப்பையும் ஏற்றுக்கொண்டிருந்த மோடியின் ஆசீர்வாதத்தோடுதான். அசோக் பட் தொடர்ந்து வி.ஹெச்.பி தலைவர்களுடன் தொடர்புக் கொண்டிருந்தார் என்பதை அவரது மொபைல் ஃபோன் ஆவணங்கள் தெரிவிக்கின்றன.
3.இனப் படுகொலைகள் நடைபெறும் வேளையில் பாரபட்சமற்ற முறையில் செயல்பட்ட நேர்மையான அதிகாரிகளை முக்கியத்துவம் இல்லாத துறைகளுக்கு மாற்றம் செய்தார். பா.ஜ.க தலைவர்களின் சொல்லுக்கு கீழ்படியாததால்தான் உள்துறை அமைச்சகத்தின் கீழ் இந்த இடமாற்றங்கள் நடந்தேறின.
4.இனப்படுகொலை நடந்த வேளையில் பரிமாறப்பட்ட வயர்லெஸ் செய்திகள் அழிக்கப்பட்டன. இக்காலக்கட்டத்தில் சட்டம் ஒழுங்கைக் குறித்து ஒரு ஆவணமும் மீதம் வைக்காமல் அழிக்கப்பட்டன.
5.தலைநகரான அஹ்மதாபாத்தில் ஏராளமான முஸ்லிம்கள் கூட்டுப் படுகொலைச் செய்யப்பட்ட பகுதிகளுக்கு செல்லாமல், ஒரேநாளில் 300 கி.மீ பயணம் செய்து ரெயில் எரிக்கப்பட்ட கோத்ராவுக்கு சென்று பாரபட்சமாக நடந்துக் கொண்டார். இந்த செயலுக்கு மோடி எந்த காரணத்தையும் தெரிவிக்கவில்லை.
6.வி.ஹெச்.பி, ஆர்.எஸ்.எஸ் தொடர்புடையவர்களை அரசுதரப்பு வழக்கறிஞர்களாக நியமித்தார். இவ்வாறு நியமிக்கப்பட்டவர்களெல்லாம் ஏதேனும் வகையில் சங்க்பரிவார்களுடன் தொடர்புடையவர்கள்.
7.2002 பிப்ரவரி 28-ஆம் தேதி வி.ஹெச்.பி அறிவித்த சட்டவிரோத முழு அடைப்பினை தடுக்க அரசு நடவடிக்கை எடுக்கவில்லை. முழு அடைப்பிற்கு பா.ஜ.க ஆதரவு தெரிவித்தது.
8.பிப்ரவரி 28-ஆம் தேதி நரோடாவில் மதியம் 12 மணி தாண்டிய பிறகும், மேகானி நகரில் மதியம் இரண்டு மணிவரையும் போலீஸ் ஊரடங்கு உத்தரவு பிறப்பிக்கவில்லை. அப்பொழுது நிலைமை கைநழுவிப் போனது.
9.நரோடா, குல்பர்க் சொசைட்டி கூட்டுப் படுகொலைகளில் போலீஸ் ஆழமாக விசாரிக்கவில்லை. வி.ஹெச்.பி, பா.ஜ.க தலைவர்களின் ஃபோன் ஆவணங்களை பரிசோதிக்கவில்லை.
10.அமைச்சர்களான கோர்தான் ஸதாஃபியா, மாயாபென் கோட்னானி ஆகியோருக்கு எதிராக தெளிவான ஆதாரங்கள் உள்ளன.
ரெய்டுகள் நடத்துவதற்கும், கைதுச் செய்வதற்கும் அதிகாரமில்லாததால் மோடி உள்ளிட்டவர்களின் வாக்குமூலத்தை பதிவுச்செய்து, ஆவணங்களை பரிசோதித்தும் அறிக்கை தயார் செய்ததாக எஸ்.ஐ.டி தெரிவித்துள்ளது. இனப்படுகொலையை நடத்த மோடியின் வீட்டில் ரகசியக் கூட்டம்.
கோத்ரா ரெயில் எரிப்பு சம்பவத்தைத் தொடர்ந்து 2002 பிப்ரவரி 27-ஆம் தேதி இரவு முதல்வரின் வீட்டில் வைத்து குஜராத் மூத்த அரசு அதிகாரிகளின் கூட்டம் நடத்தப்பட்டதாக எழுப்பப்பட்ட குற்றச்சாட்டை உச்சநீதிமன்றத்தால் நியமிக்கப்பட்ட சிறப்பு புலனாய்வுக்குழு ((SIT Report)) உறுதிச் செய்துள்ளது.
இந்த ரகசியக் கூட்டத்தில் வைத்துதான் முஸ்லிம்களை அதிகமாக கொலைச் செய்வதற்கும், அதற்காக அரசு துறைகளை செயலிழக்க வைக்கவும் நரேந்திர மோடியும் அவரது கும்பலும் தீர்மானித்தது என குல்பர் சொசைட்டியில் கொடூரமாக் கொலைச் செய்யப்பட்ட முன்னாள் காங்கிரஸ் எம்.பி இஹ்ஸான் ஜாஃப்ரியின் மனைவி ஸாக்கியா ஜாஃப்ரி குற்றஞ்சாட்டியிருந்தார். ஆனால், இதனை மோடி மறுத்து வந்தார்.
27.02.02 அன்று கோத்ராவுக்கு சென்று அஹ்மதாபாத் திரும்பிய பிறகு ரகசியக் கூட்டத்தை கூட்டினார் என ஆர்.கே.ராகவன் தலைமையிலான சிறப்பு புலனாய்வுக் குழுவின் அறிக்கை கூறுகிறது. இந்தக் கூட்டத்தில் பங்கேற்றவர்களிடம் நடத்திய விசாரணை விபரங்கள் இவ்வறிக்கையில் கொடுக்கப்பட்டுள்ளன.
மோடி, முதன்மைச் செயலாளரின் பொறுப்புவகித்த ஸ்வர்ணகாந்த்வர்மா, உள்துறை அமைச்சகத்தின் பொறுப்பேற்றிருந்த கூடுதல் முதன்மைச் செயலாளர் அசோக் நாராயணன், டி.ஜி.பி.கே.சதுர்வேதி, அஹ்மதாபாத் போலீஸ் கமிஷனர் பி.சி.பாண்டே, உள்துறைச் செயலாளர் கெ.நித்யானந்தம், முதல்வரின் முதன்மைச் செயலாளர் பி.கே.மிஷ்ரா, மோடியின் செயலாளர் அனில் முகிம் ஆகியோர் கூட்டத்தில் பங்கேற்றனர்.
ஸ்வர்ணகாந்த் வர்மா, அசோக் நாராயணன் ஆகியோரை விசாரித்த பொழுது கேட்கப்பட்ட, ஹிந்துக்களுக்கு தங்களது கோபத்தை வெளிப்படுத்த அனுமதிக்க வேண்டுமென முதல்வர் கட்டளையிட்டாரா? என்ற கேள்வியை ஒப்புக்கொள்ளவோ, மறுக்கவோ இருவரும் தயாராக இல்லை என எஸ்.ஐ.டியின் அறிக்கையில் கூறப்பட்டுள்ளது. 2009 ஆம் ஆண்டு பணியிலிருந்து ஓய்வு பெற்ற பிறகு மிஷ்ராவை குஜராத் மின்சாரா வாரிய ஒழுங்குமுறை கமிஷனின் செயலாளராகவும், பி.சி.பாண்டேயை போலீஸ் வீட்டுவசதி வாரியத்தின் தலைவராகவும் குஜராத் மோடி அரசு நியமித்தது.
தற்போதைய குஜராத் மாநில போலீஸ் வீட்டுவசதி வாரியத்தின் மேலாண்மை இயக்குநராக செயல்படுகிறார் நித்யானந்தம். முஸ்லிம் இனப்படுகொலைக்கு பிறகு அசோக் நாராயணன் முதன்மை செயலாளராக நியமிக்கப்பட்டார். மோடி மற்றும் குஜராத் அரசுக்கெதிராக எதுவும் பேசாமலிருக்கத்தான் பாண்டே, மிஷ்ரா, அசோக் நாராயணன் ஆகியோருக்கு புதிய பதவிகள் வழங்கப்பட்டன.
இனப்படுகொலையில் மோடியின் பங்கினைக் குறித்து குஜராத் ரெவனியூ அமைச்சராக இருந்த ஹரண் பாண்டியா, நீதிபதி ஹோஸ்பேட் சுரேஷ், நீதிபதி பி.பி.சாவந்த் ஆகியோர் சுதந்திர தீர்ப்பாயத்திடம் வாக்குமூலம் அளித்தையும் எஸ்.ஐ.டியின் அறிக்கையில் சுட்டிக் காட்டப்பட்டுள்ளது. 2003 ஆம் ஆண்டு மர்மமான முறையில் பாண்டே கொல்லப்பட்டிருந்தார்.
விசாரணையின் போது மோடி கூறியதெல்லாம் பொய், முஸ்லிம் இனப்படுகொலையில் ஒரு டஜனுக்கும் மேற்பட்ட குற்றங்களில் பங்குள்ளதாக கண்டறியப்பட்ட குஜராத் முதல்வர் மோடி; விசாரணையின்போது தெரிவித்ததெல்லாம் பொய் என எஸ்.ஐ.டி தனது அறிக்கையில் (SIT Report) கூறியுள்ளது.
ஆதாரங்களை முன்வைத்து கடந்த மார்ச் 28-ஆம் தேதி எஸ்.ஐ.டி காந்திநகர் அலுவலகத்தில் வைத்து விசாரணை அதிகாரி எ.கெ.மல்கோத்ரா கேட்ட கேள்விகளுக்கு பதில் கூறாமல் மழுப்பியும், மறந்துவிட்டதாக நடித்தும், பொய்களைக் கூறியும் நழுவினார் என எஸ்.ஐ.டி தெரிவித்துள்ளது. கவ்ரவ் யாத்திரையின் ஒருபகுதியாக கடந்த 2002 ஆம் ஆண்டு செப்டம்பர் ஒன்பதாம் தேதி மெஹ்ஸானா மாவட்டத்தில் பெச்சாரியில் மோடி நிகழ்த்திய உணர்ச்சியைத் தூண்டும் உரையின் ஆவணத்தை மேஜையின் வைத்துவிட்டு இதனைக் குறித்து மோடியிடம் மல்கோத்ரா கேள்வி எழுப்பினார்.
"ஏன் சகோதரர்களே நாம் அகதி முகாம்களை திறக்கிறோம்?குழந்தைகளை உற்பத்திச் செய்யும் மையங்களை திறக்கத்தான் வேண்டுமா? நாம் முன்னேற்றமடைய குடும்ப கட்டுப்பாடு திட்டத்தை நடைமுறைப்படுத்த வேண்டாமா? நமக்கு ஐந்து அவர்களுக்கு இருபத்தி ஐந்தாகும். அவர்களை இதிலிருந்து விலக்கவேண்டும். அந்த மதத்தினரை நம்முடைய வழியில் கொண்டுவர வேண்டும். ஏன் ஏழைகளுக்கு பணம் சென்று சேரவில்லை?" -இந்த உரையின் பகுதியைத்தான் மோடியின் முன்னால் வைத்துவிட்டு இந்த உரை முஸ்லிம்களுக்கு எதிரானது அல்லவா? என்பது மல்கோத்ராவின் கேள்வியாகும். இது அரசியல் ரீதியான உரை என மோடி மழுப்பியுள்ளார்.
கோத்ரா கலவரத்தில் தேசம் நடுங்கி நிற்கும் வேளையில் அடிக்கு பதிலடி உண்டாகும் என 2002 மார்ச் ஒன்றாம் தேதி 'ஸீ' டி.விக்கு அளித்த பேட்டியில் மோடி கூறியதைக் குறித்து அடுத்த வினா தொடுக்கப்பட்டது. கோத்ரா பகுதியிலுள்ளவர்கள் கிரிமினல் குணத்தைக் கொண்டவர்கள். ஏற்கனவே அவர்கள் ஒரு டீச்சரை கொலைச் செய்துள்ளனர். அதற்கு பதிலடிதான் அவர்கள் அனுபவிக்கிறார்கள் என தொலைக்காட்சிக்கு அளித்த பேட்டியில் கூறியிருந்தார். இதற்கு பதிலளித்த மோடி, தொலைக்காட்சிக்கு பேட்டியளித்து எட்டு ஆண்டுகள் கழிந்துள்ளதால் அன்று உபயோகித்த வார்த்தைகள் ஞாபகத்தில் இல்லை என தெரிவித்துள்ளார்.
கேட்ட கேள்விகளுக்கெல்லாம் மழுப்பலான நழுவும் விதமான பதில்களை கூறியுள்ளார் மோடி.

புதுடெல்லி,பிப்.5:2002 ஆம் ஆண்டு குஜராத் முஸ்லிம் இனப் படுகொலையில் அம்மாநில முதல்வர் நரேந்திர மோடிக்கு தெளிவான பங்கிருப்பதாக உச்சநீதிமன்றத்தால் நியமிக்கப்பட்ட சிறப்பு புலனாய்வுக் குழு (SIT) கண்டறிந்துள்ளது. பாரபட்சமாக நடந்துக் கொண்டும், நடவடிக்கைகள் மேற்கொள்ளாமலும், பாதிக்கப்பட்டவர்களை புறக்கணித்தும் கலவரத்திற்கு உதவியதாக மோடி மீது குற்றஞ்சாட்டி எஸ்.ஐ.டி தனது அறிக்கையில் கூறியுள்ளது.
2010 ஆம் ஆண்டு மே மாதம் 12-ஆம் தேதி விசாரணையை பூர்த்திச் செய்து முத்திரை வைக்கப்பட்ட உறையில் வைத்து உச்சநீதிமன்றத்தில் எஸ்.ஐ.டி சமர்ப்பித்த அறிக்கையை டெஹல்கா பத்திரிகை வெளியிட்டுள்ளது. இனப்படுகொலையை தடுத்து நிறுத்துவதிலும், வகுப்புவெறியை தூண்டிவிட்ட பத்திரிகைகளுக்கு எதிராக நடவடிக்கை எடுப்பதிலும் மோடி தோல்வியடைந்தார் என அவ்வறிக்கை கூறுகிறது.
சட்டமன்ற தேர்தலுக்கு முன்னோடியாக 2002 ஆம் ஆண்டு ஆகஸ்ட் மாதம் மாநிலத்தில் சட்ட-ஒழுங்கு பிரச்சனை திருப்தியாக உள்ளதாக குஜராத் அரசு தவறான அறிக்கை வெளியிட்டதையும் இவ்வறிக்கை சுட்டிக் காட்டுகிறது. மோடியை குற்றமற்றவராக்கி எஸ்.ஐ.டி அறிக்கையை தாக்கல் செய்துள்ளதாக ஏற்கனவே செய்திகள் வெளியாகியிருந்தன. மோடியின் மீதான நம்பிக்கையை தகர்ப்பதற்கான முயற்சிகளுக்கு கிடைத்த பதிலடி இவ்வறிக்கை என அப்பொழுது அத்வானி உள்ளிட்ட பா.ஜ.க தலைவர்கள் கருத்துத் தெரிவித்திருந்தனர்.
பா.ஜ.கவின் எதிர்பார்ப்புகளுக்கு கடுமையான பதிலடி தரும்விதத்தில் முஸ்லிம் இனப்படுகொலையில் மோடியின் பங்கைக் குறித்து எஸ்.ஐ.டியின் அறிக்கை விரிவாக கூறுகிறது. வகுப்புவாத சிந்தனையோடு செயல்பட்டார், உணர்ச்சியைத் தூண்டும் உரைகளை நிகழ்த்தினார், முக்கியமான ஆதாரங்களை அழித்தார், சங்க்பரிவார உறுப்பினர்களை அரசு தரப்பு வழக்கறிஞராக நியமித்தார், பாதிக்கப்பட்டவர்களுக்கு நீதியை மறுத்தார், இனப்படுகொலை நிகழும் வேளையில் போலீஸ் கட்டுப்பாட்டு அறைகளில் சட்ட விரோதமாக அமைச்சர்களை நியமித்தார். பாரபட்சமின்றி நடந்துக் கொண்ட அதிகாரிகளை தொந்தரவுச் செய்தார் ஆகிய காரியங்களில் மோடி குற்றவாளி என எஸ்.ஐ.டியின் அறிக்கை தெளிவுப்படுத்துகிறது.அரசுத்துறைகள் ஒன்று செயலிழந்து போனது அல்லது கலவரத்தை மேலும் கொளுந்து விட்டெரியும் விதத்தில் செயல்பட்டது என அறிக்கை விரிவாக கூறுகிறது. தீங்கு விளைவிக்கக்கூடிய, குற்றகரமான விமர்சனங்களை முஸ்லிம்களுக்கு எதிராக தெரிவித்த மோடி உயர்ந்த பதவியிலிருந்துக் கொண்டு சிந்தனையற்ற பொறுப்பற்ற முறையில் நடந்துக் கொண்டார் என எஸ்.ஐ.டியின் அறிக்கை கூறுகிறது.
எஸ்.ஐ.டியின் அறிக்கையில் முக்கிய பகுதிகள்:
1.குல்பர்க் சொசைட்டி, நரோடா பாட்டியா உள்பட மாநிலம் முழுவதும் முஸ்லிம்கள் கொடூரமாக தாக்கப்பட்ட பொழுது யாரும் எதிர்பார்க்காத வகையில் முதல்வரும், அரசும் நடந்துக் கொண்டது. எல்லா வினைகளுக்கும் எதிர்வினைகள் உண்டு என்று கூறி முஸ்லிம்களுக் கெதிரான கலவரத்தை நியாயப்படுத்தினார் மோடி. கோத்ராவிலும், அதன் சுற்று வட்டாரங்களிலும் குற்ற வாசனையுடையவர்கள் இருக்கின்றார்கள் என மோடி குற்றஞ்சாட்டியது ஹிந்து-முஸ்லிம் பிரிவினரிடையே மேலும் உணர்ச்சியை தூண்டிவிட்டது.
2.அசோக் பட், ஐ.கே.ஜடேஜா ஆகிய அமைச்சர்களை அஹமதாபாத் நகர போலீஸ் கட்டுப்பாட்டு அறையிலும், மாநில போலீஸ் கட்டுப்பாட்டு அறையிலும் நியமித்தார். இனப்படுகொலை நடைபெறும் பொழுது போலீஸ் நடவடிக்கைகளை இவர்கள் சீர்குலைத்ததற்கு காரணம் உள்துறை அமைச்சகத்தின் பொறுப்பையும் ஏற்றுக்கொண்டிருந்த மோடியின் ஆசீர்வாதத்தோடுதான். அசோக் பட் தொடர்ந்து வி.ஹெச்.பி தலைவர்களுடன் தொடர்புக் கொண்டிருந்தார் என்பதை அவரது மொபைல் ஃபோன் ஆவணங்கள் தெரிவிக்கின்றன.
3.இனப் படுகொலைகள் நடைபெறும் வேளையில் பாரபட்சமற்ற முறையில் செயல்பட்ட நேர்மையான அதிகாரிகளை முக்கியத்துவம் இல்லாத துறைகளுக்கு மாற்றம் செய்தார். பா.ஜ.க தலைவர்களின் சொல்லுக்கு கீழ்படியாததால்தான் உள்துறை அமைச்சகத்தின் கீழ் இந்த இடமாற்றங்கள் நடந்தேறின.
4.இனப்படுகொலை நடந்த வேளையில் பரிமாறப்பட்ட வயர்லெஸ் செய்திகள் அழிக்கப்பட்டன. இக்காலக்கட்டத்தில் சட்டம் ஒழுங்கைக் குறித்து ஒரு ஆவணமும் மீதம் வைக்காமல் அழிக்கப்பட்டன.
5.தலைநகரான அஹ்மதாபாத்தில் ஏராளமான முஸ்லிம்கள் கூட்டுப் படுகொலைச் செய்யப்பட்ட பகுதிகளுக்கு செல்லாமல், ஒரேநாளில் 300 கி.மீ பயணம் செய்து ரெயில் எரிக்கப்பட்ட கோத்ராவுக்கு சென்று பாரபட்சமாக நடந்துக் கொண்டார். இந்த செயலுக்கு மோடி எந்த காரணத்தையும் தெரிவிக்கவில்லை.
6.வி.ஹெச்.பி, ஆர்.எஸ்.எஸ் தொடர்புடையவர்களை அரசுதரப்பு வழக்கறிஞர்களாக நியமித்தார். இவ்வாறு நியமிக்கப்பட்டவர்களெல்லாம் ஏதேனும் வகையில் சங்க்பரிவார்களுடன் தொடர்புடையவர்கள்.
7.2002 பிப்ரவரி 28-ஆம் தேதி வி.ஹெச்.பி அறிவித்த சட்டவிரோத முழு அடைப்பினை தடுக்க அரசு நடவடிக்கை எடுக்கவில்லை. முழு அடைப்பிற்கு பா.ஜ.க ஆதரவு தெரிவித்தது.
8.பிப்ரவரி 28-ஆம் தேதி நரோடாவில் மதியம் 12 மணி தாண்டிய பிறகும், மேகானி நகரில் மதியம் இரண்டு மணிவரையும் போலீஸ் ஊரடங்கு உத்தரவு பிறப்பிக்கவில்லை. அப்பொழுது நிலைமை கைநழுவிப் போனது.
9.நரோடா, குல்பர்க் சொசைட்டி கூட்டுப் படுகொலைகளில் போலீஸ் ஆழமாக விசாரிக்கவில்லை. வி.ஹெச்.பி, பா.ஜ.க தலைவர்களின் ஃபோன் ஆவணங்களை பரிசோதிக்கவில்லை.
10.அமைச்சர்களான கோர்தான் ஸதாஃபியா, மாயாபென் கோட்னானி ஆகியோருக்கு எதிராக தெளிவான ஆதாரங்கள் உள்ளன.
ரெய்டுகள் நடத்துவதற்கும், கைதுச் செய்வதற்கும் அதிகாரமில்லாததால் மோடி உள்ளிட்டவர்களின் வாக்குமூலத்தை பதிவுச்செய்து, ஆவணங்களை பரிசோதித்தும் அறிக்கை தயார் செய்ததாக எஸ்.ஐ.டி தெரிவித்துள்ளது. இனப்படுகொலையை நடத்த மோடியின் வீட்டில் ரகசியக் கூட்டம்.
கோத்ரா ரெயில் எரிப்பு சம்பவத்தைத் தொடர்ந்து 2002 பிப்ரவரி 27-ஆம் தேதி இரவு முதல்வரின் வீட்டில் வைத்து குஜராத் மூத்த அரசு அதிகாரிகளின் கூட்டம் நடத்தப்பட்டதாக எழுப்பப்பட்ட குற்றச்சாட்டை உச்சநீதிமன்றத்தால் நியமிக்கப்பட்ட சிறப்பு புலனாய்வுக்குழு ((SIT Report)) உறுதிச் செய்துள்ளது.

ஆதாரங்களை முன்வைத்து கடந்த மார்ச் 28-ஆம் தேதி எஸ்.ஐ.டி காந்திநகர் அலுவலகத்தில் வைத்து விசாரணை அதிகாரி எ.கெ.மல்கோத்ரா கேட்ட கேள்விகளுக்கு பதில் கூறாமல் மழுப்பியும், மறந்துவிட்டதாக நடித்தும், பொய்களைக் கூறியும் நழுவினார் என எஸ்.ஐ.டி தெரிவித்துள்ளது. கவ்ரவ் யாத்திரையின் ஒருபகுதியாக கடந்த 2002 ஆம் ஆண்டு செப்டம்பர் ஒன்பதாம் தேதி மெஹ்ஸானா மாவட்டத்தில் பெச்சாரியில் மோடி நிகழ்த்திய உணர்ச்சியைத் தூண்டும் உரையின் ஆவணத்தை மேஜையின் வைத்துவிட்டு இதனைக் குறித்து மோடியிடம் மல்கோத்ரா கேள்வி எழுப்பினார்.
"ஏன் சகோதரர்களே நாம் அகதி முகாம்களை திறக்கிறோம்?குழந்தைகளை உற்பத்திச் செய்யும் மையங்களை திறக்கத்தான் வேண்டுமா? நாம் முன்னேற்றமடைய குடும்ப கட்டுப்பாடு திட்டத்தை நடைமுறைப்படுத்த வேண்டாமா? நமக்கு ஐந்து அவர்களுக்கு இருபத்தி ஐந்தாகும். அவர்களை இதிலிருந்து விலக்கவேண்டும். அந்த மதத்தினரை நம்முடைய வழியில் கொண்டுவர வேண்டும். ஏன் ஏழைகளுக்கு பணம் சென்று சேரவில்லை?" -இந்த உரையின் பகுதியைத்தான் மோடியின் முன்னால் வைத்துவிட்டு இந்த உரை முஸ்லிம்களுக்கு எதிரானது அல்லவா? என்பது மல்கோத்ராவின் கேள்வியாகும். இது அரசியல் ரீதியான உரை என மோடி மழுப்பியுள்ளார்.
கோத்ரா கலவரத்தில் தேசம் நடுங்கி நிற்கும் வேளையில் அடிக்கு பதிலடி உண்டாகும் என 2002 மார்ச் ஒன்றாம் தேதி 'ஸீ' டி.விக்கு அளித்த பேட்டியில் மோடி கூறியதைக் குறித்து அடுத்த வினா தொடுக்கப்பட்டது. கோத்ரா பகுதியிலுள்ளவர்கள் கிரிமினல் குணத்தைக் கொண்டவர்கள். ஏற்கனவே அவர்கள் ஒரு டீச்சரை கொலைச் செய்துள்ளனர். அதற்கு பதிலடிதான் அவர்கள் அனுபவிக்கிறார்கள் என தொலைக்காட்சிக்கு அளித்த பேட்டியில் கூறியிருந்தார். இதற்கு பதிலளித்த மோடி, தொலைக்காட்சிக்கு பேட்டியளித்து எட்டு ஆண்டுகள் கழிந்துள்ளதால் அன்று உபயோகித்த வார்த்தைகள் ஞாபகத்தில் இல்லை என தெரிவித்துள்ளார்.
கேட்ட கேள்விகளுக்கெல்லாம் மழுப்பலான நழுவும் விதமான பதில்களை கூறியுள்ளார் மோடி.
மோடிக்கு எதிராக ஒரு எஃப்.ஐ.ஆர் கூட பதிவுச் செய்ய எஸ்.ஐ.டியால் முடியவில்லை.
