மேலும் இந்த தீர்ப்பு நீதிமன்ற சட்டத்தில் எங்கும் இல்லாத புதிய வழிமுறையை வகுத்துள்ளது, அதாவது இனிமேல் யார் வேண்டுமானாலும் இந்த இடம் இந்த கடவுள் அல்லது கடவுள் தன்மையுள்ள ஒருவர் பிறந்த இடம் எனக்கு கூறி ஆதாரம் ஏதும் காட்டாமல் நிலத்தை உரிமை கொண்டாட இந்த தீர்ப்பு வழிவகை செய்துள்ளது எனக் கூறி தீர்ப்பின் கோமாளித்தனத்தை தெளிவுபடுத்தியுள்ளார்.

Historical evidence ignored, say historians

The verdict is a political judgment and reflects a decision which could as well have been taken by the state years ago. Its focus is on the possession of land and the building a new temple to replace the destroyed mosque. The problem was entangled in contemporary politics involving religious identities but also claimed to be based on historical evidence. This latter aspect has been invoked but subsequently set aside in the judgment.

The court has declared that a particular spot is where a divine or semi-divine person was born and where a new temple is to be built to commemorate the birth. This is in response to an appeal by Hindu faith and belief. Given the absence of evidence in support of the claim, such a verdict is not what one expects from a court of law. Hindus deeply revere Rama as a deity but can this support a legal decision on claims to a birth-place, possession of land and the deliberate destruction of a major historical monument to assist in acquiring the land?

The verdict claims that there was a temple of the 12th Century AD at the site which was destroyed to build the mosque — hence the legitimacy of building a new temple.

The excavations of the Archaeological Survey of India (ASI) and its readings have been fully accepted even though these have been strongly disputed by other archaeologists and historians. Since this is a matter of professional expertise on which there was a sharp difference of opinion the categorical acceptance of the one point of view, and that too in a simplistic manner, does little to build confidence in the verdict. One judge stated that he did not delve into the historical aspect since he was not a historian but went to say that history and archaeology were not absolutely essential to decide these suits! Yet what are at issue are the historicity of the claims and the historical structures of the past one millennium.

A mosque built almost 500 years ago and which was part of our cultural heritage was destroyed wilfully by a mob urged on by a political leadership. There is no mention in the summary of the verdict that this act of wanton destruction, and a crime against our heritage, should be condemned. The new temple will have its sanctum — the presumed birthplace of Rama — in the area of the debris of the mosque. Whereas the destruction of the supposed temple is condemned and becomes the justification for building a new temple, the destruction of the mosque is not, perhaps by placing it conveniently outside the purview of the case.
Has created a precedent

The verdict has created a precedent in the court of law that land can be claimed by declaring it to be the birthplace of a divine or semi-divine being worshipped by a group that defines itself as a community. There will now be many such janmasthans wherever appropriate property can be found or a required dispute manufactured. Since the deliberate destruction of historical monuments has not been condemned what is to stop people from continuing to destroy others? The legislation of 1993 against changing the status of places of worship has been, as we have seen in recent years, quite ineffective.

What happened in history, happened. It cannot be changed. But we can learn to understand what happened in its fuller context and strive to look at it on the basis of reliable evidence. We cannot change the past to justify the politics of the present. The verdict has annulled respect for history and seeks to replace history with religious faith. True reconciliation can only come when there is confidence that the law in this country bases itself not just on faith and belief, but on evidence.

இன்றைக்கு எத்தனையோ முஸ்லிம் இளைஞர்கள் உடல் மண்ணுக்கு உயிர் ரஜினிக்கு எனக் கூறி தனது இளைய பருவத்தை வீணடித்துக் கொண்டிருகின்றனர். யார் இந்த ரஜினிகாந்த என்ற உண்மையை இந்த முஸ்லிம் சமுதாய இளைஞர்கள் உணர வேண்டும். முஸ்லிம் இனமே இந்தியாவில் இருக்கக்கூடாது என்பதை அடிப்படை கொள்கையாக கொண்டுள்ள பாசிச இயக்கத் தலைவன் தான் பால் தாக்ரே. இந்த பால்தாக்ரே தான் ரஜினிக்கு கடவுளாம்.

அப்படி எனில் கடவுளின் கொள்கையை (பாசிசம்) தான் பக்கதனும் (ரஜினி) பின் பற்றுவார் என்பது இதிலிருந்து தௌ்ளத் தெளிவாகத் தெரிகின்றது

மரண அறிவிப்பு

அறுபது ஆண்டுகளுக்கும் மேலாக கோமாவில் கிடந்த நீதி வியாழக்கிழமை அலகாபாத் கட்டைப்பஞ்சாயத்து தாதாக்கள் வழங்கிய தீர்ப்பால் செத்து போனது. இதற்கு பிறகும் செத்து போன நீதியை உயிரூட்ட உச்ச நீதிமன்றம் கொண்டு செல்வோரின் நிலையை நினைத்து பரிதாப்படுவதை தவிர வேறில்லை.

கிடைத்த மூன்றில் ஒரு பங்கு நிலத்தில் இந்திய முஸ்லிம்கள் பள்ளிவாசல் கட்டலாம் என்று மனப்பால் குடிக்க வேண்டாம். புத்திசாலித்தனமாக அதை கப்ருஸ்தானாக பயன்படுத்திக் கொள்வது சிறந்தது. (கப்ருஸ்தான் = இறந்தவர்களை அடக்கம் செய்யும் இடம்).

பாபர் மசூதி நிலத்தை ஏன் கப்ருஸ்தானாக பயன்படுத்த வேண்டும்?
இனி வரும் காலங்களில் மதுரா பள்ளிவாசலின் உட்புறத்தில் தான் கிருஷ்ணர் பிறந்ததாகவும், காசி பள்ளிவாசலில் சிவன் பிறந்ததாகவும், இன்னும் ஆயிரக்கணக்கான பள்ளிவாசல்களில் லோக்கல் குலதெய்வங்கள் பிறந்ததாகவும் இந்துத்துவாக்கள் கதையளந்து விட்டு அந்த பள்ளிவாசல்களை தகர்க்க வெடிகுண்டுகள் , கடப்பாரைகளுடன் கரசேவை செய்ய வரும் போது அவற்றை உணர்ச்சி மிக்க இஸ்லாமிய இளைஞர்கள் கண்டிப்பாக தடுப்பார்கள். அரசோ கண்டிப்பாக கரசேவை செய்பவர்களுக்கு தான் பாதுகாப்பாக இருக்கும். எனவே முஸ்லிம்கள் ஆயிரக்கணக்கில் படுகொலை செய்யப்படுவது நிச்சயம். அப்போது பலியாகின்ற இந்திய முஸ்லிம்களை புதைக்க இடப்பற்றாக்குறை ஏற்படும். எனவே அயோத்தியில் இப்போது வழங்கப்பட்டிருக்கின்ற இடத்தை கப்ருஸ்தானாக பயன்படுத்திக் கொள்வது நல்ல வழிமுறையாகும்.

தீர்ப்பு (கட்டைபஞ்சாயத்து) குறித்த சில சந்தேகங்கள்:
1) மத நம்பிக்கைகளில் நீதிமன்றங்கள் தலையிட முடியாது. பாபர் மஸ்ஜித் தொடர்பாக நீதிமன்றங்கள் வழங்கும் நீதியை ஏற்றுக் கொள்ள மாட்டோம் என இதுவரைக்கும் முழங்கிய அத்வானி உட்பட இந்துத்துவா வெறியர்கள் அனைவரும் சொல்லிவைத்தது போன்று இந்த தீப்பை மட்டும் ஏற்றுக் கொள்கிறோம் என்றும், தீர்ப்பு வெளிவரும் முன்னரே நமக்கு சாதகமாக தான் தீர்ப்பு வரும் என்று சில இந்துத்துவா வெறியர்கள் அறிக்கைகள் கொடுத்ததற்கும், இந்த கட்டைப்பஞ்சாயத்து தீர்ப்பு எழுதப்பட்டதர்க்கும் ஏதாவது சம்பந்தம் இருக்குமா?

2) சொத்து சம்பந்தமான வழக்கு நீதிமன்றங்களுக்கு வரும்போது, சொத்துக்கான பத்திரங்களை அல்லது அனுபவ பாத்தியதையை அடிப்படையாக வைத்து நீதிமன்றங்கள் தீர்ப்பு வழங்குமா அல்லது குருட்டு நம்பிக்கைகளின் அடிப்படையில் தீர்ப்பு வழங்குமா?

3) இராமரை வால்மீகி எழுதிய இராமாயணம் மூலம் தான் நாம் அறிந்து கொள்ள முடியும். இராமாயணத்தின்படி இராமர் 17 லட்சம் ஆண்டுகளுக்கு முன்னால் வாழ்ந்தவர். அப்படிப்பட்டவர் குறிப்பிட்ட இடத்தில் தான் பிறந்தவர் என்று எவ்வாறு அந்த அறிவுஜீவிகள் முடிவு பண்ணினர்?

4) இராமாயணத்தின்படி இராமர் பிறந்த அயோத்திக்கு 23 கி.மி க்கு அப்பால் சரயூ நதி என்று ஒரு நதி ஓட வேண்டும். அப்படி எந்த ஒரு நதியையும் அங்கே காண முடிவதில்லை. ஆனால் அயோத்தியிலேயே சரயூ என்ற நதி ஓடுகிறது. அயோத்தியில் ஓடுகிற அந்த நதி தான் இராமாயணம் சொல்லுகின்ற நதி என்று யாராவது கூறினால், இராமயணத்தில் சரயூ நதி கங்கையில் சங்கமிப்பதாக சொல்லப்படுகிறது. ஆனால் அயோத்தியில் ஓடும் சரயூ நதி ராப்தி என்னும் நதியில் சங்கமிக்கின்றது. கிழக்கிலிருந்து மேற்கு நோக்கி சரயூ நதி பாய்வதாக இராமாயணம் சொல்லுகிறது. ஆனால் இன்றையோ அயோத்தி நதியோ மேற்கிலிருந்து கிழக்கு நோக்கி பாய்கின்றது. எனவே தீர்ப்பு சொன்ன புண்ணியவான்கள் ஒன்று இராமயணத்தை மாற்ற சொல்ல வேண்டும். இல்லையெனில் இராமயணத்தில் சொல்லப்பட்டு காணாமல் போன சரயூ நதி மற்றும் கங்கை நதிகளை எல்லாம் கண்டுபிடித்து தர வேண்டும் என்று யாராவது வழக்கு போட்டால் அதை நீதிமன்றம் ஏற்றுக் கொள்ளுமா?

5) பள்ளிவாசல் கட்டுவதற்கு முன்னர் இந்திய தொல்பொருள் துறையினரை அழைத்து பள்ளிவாசல் கட்டும் நிலத்தில் ஆய்வை செய்ய சொல்லி விட வேண்டும். ஏனெனில் பூமிக்கடியில் ஏதாவது சிறு துகள் மாட்டினாலும் அவை கோயில் தான் என்று பிற்காலத்தில் நீதிமன்றம் சொல்லி விடும். எனவே முன் எச்சரிக்கையாக இருப்பது நல்லது தானே. ஒவ்வொரு பள்ளிவாசல் கட்டும்போதும் இவ்வாறு ஆய்வு செய்ய முஸ்லிம்கள் அழைத்தால் இந்திய தொல்பொருள் இலாகா வருமா?

6) ஒருவர் ஒரு இடத்தில் பிறந்ததாலேயே அவருக்கு அந்த இடம் சொந்தமாகி விடுமா? அப்படியென்றால் நான் அரசு மருத்துவமனையில் பிறந்தேன். அதற்கான பிறப்பு சான்றிதழும் என்னிடம் உண்டு. இதை நீதிமன்றத்தில் தாக்கல் செய்தால் அந்த அரசு மருத்துவமனையை என்னுடைய சொத்தாக நீதிமன்றம் மாற்றிக் கொடுத்து விடுமா?

பாபர் மஸ்ஜித் நீதிமன்ற தீர்ப்பு இந்திய முஸ்லிம்களுக்கு சொல்லும் சில செய்திகள்:
இந்த நாட்டை பொறுத்தவரை என்ன தான் நாட்டின் சுதந்திரத்திற்காக தம்முடைய சதவிகிதத்திற்கும் அதிகமாக தியாகங்களை முஸ்லிம்கள் செய்திருந்தாலும் இரண்டாம் தர குடிமக்களாகவே கருதப்படுவார்கள். பள்ளிவாசல் கட்டி வழிபாடு செய்ய உரிமை உண்டு. ஆனால் இந்துத்துவாக்கள் அதை எதிர்க்காதவரை. அவர்கள் எதிர்த்து உங்களுடைய பள்ளிவாசலில் தான் என்னுடைய குலதெய்வம் பிறந்தார் என்று வழக்கை தொடுக்கும் வரை. எனவே முடிந்த வரையில் முஸ்லிம்கள் நீதிமன்றங்களுக்கு செல்லாதீர்கள். அங்கே உங்களுக்கான நீதி ஒரு போதும் கிடைக்காது. முஸ்லிம்களே மனதில் இருத்திக் கொள்ளுங்கள். இந்திய நாட்டில் நீங்கள் இரண்டாம் தர குடிமக்களே.

Junk and processed foods should be avoided. Include a healthy diet and promote a lifestyle that includes regular exercise, not smoking, staying safe in the sun, doing self-examinations and undergoing regular medical checkups.

Sympathy and self-sacrifice

Allah, the Exalted, says: "... and do good that you may be successful". (22:77).
Relaxing in the lounge Saturday after Fajr salaah my wife called, 'How long will you be with that newspaper? Will you come here and make your darling son eat his food?'.
I tossed the paper away and rushed to the scene. My only son Faizaan looked frightened. Tears were welling up in his eyes. In front of him was a bowl filled to its brim with cereal containing the much needed vitamins needed by Faizaan after his month long illness. Faizaan was a pleasant child, quite intelligent for his age. He has just turned nine. He particularly detested the vitamin fortified cereal. My mother and my wife are traditional and believe firmly in the benefits of the age old traditional porridge cereal.
I cleared my throat, and picked up the bowl. 'Faizaan, darling, why don't you take a few mouthful of this cereal? Just for Dad's sake, dear. Faizaan softened a bit, and wiped his tears with the back of his hands. 'OK, Dad. I will eat - not just a few mouthfuls, but the whole lot of this. But, you should…' Faizan hesitated.
'Dad, if I eat this entire Cereal, will you give me whatever I ask for?'…'Oh sure, darling'… 'Promise?'...'Promise'. I covered the soft hand extended by my son with mine, and clinched the deal. 'Ask Mom also to give a similar promise', my son insisted. My wife put her hand on Faizaan’s, muttering 'Promise'. Now I became a bit anxious. ' Faizaan dear, you shouldn't insist on getting a computer or any such expensive items. Dad does not have that kind of money right now. OK?' 'No, Dad. I do not want anything expensive'. Slowly and painfully, he finished eating the whole quantity. I was silently angry with my wife and my mother for forcing my child to eat. After the ordeal was through, Faizaan came to me with his eyes wide with expectation. All our attention was on him... 'Dad, I want to have my hair on my head shaved off, this Sunday!' was his demand.
'Atrocious!' shouted my wife, 'my child having his head shaved off? Impossible!' This is following the crazy “skin heads” culture capturing the youth in our community! Never,never,never will I allow it!!! 'Never in our family!' my mother rasped.'He has been watching too much of television. Our culture is getting totally spoiled with these TV programs!' Faizaan darling, why don't you ask for something else? We will be sad seeing you with a clean-shaven head.' 'No, Dad. I do not want anything else', Faizaan said with finality. 'Please, Faizaan, why don't you try to understand our feelings?' I tried to plead with him. 'Dad, you saw how difficult it was for me to eat that cereal'. Faizaan was in tears. 'And you promised to grant me whatever I ask for. Now, you are going back on your words.
Dear beloved father, in our daily sessions of Taalim (Islamic education) was it not you who told me the stories of the Companions of our beloved Prophet Muhammad [peace be upon him] and how they kept to their promises! You did emphasize that we should honour our promises no matter what! It was time for me to call the shots. 'Our promise must be kept.' 'Are you out your mind?' chorused my mother and wife. 'No. If we go back on our promises, he will never learn to honour his own. Faizaan, your wish will be fulfilled.'
With his head clean-shaven, Faizaan had a round-face, and his eyes looked big and beautiful. On Monday morning, I dropped him at his school. It was a sight to watch my hairless Faizaan walking towards his classroom. He turned around and waved. I waved back with a smile. Just then, a boy alighted from a car, and shouted, Faizaan, please wait for me!' What struck me was the hairless head of that boy. 'May be, that is the in-stuff', I thought. 'Sir, your son Faizaan is great indeed!' Without introducing himself, a man got out of the car, and continued,' That boy who is walking along with your son is my son Yunoos. He is suffering from… leukaemia(cancer).' He paused to muffle his sobs. Yunoos could not attend the school for the whole of the last month. He lost all his hair due to the side effects of the chemotherapy. He refused to come back to school fearing the unintentional but cruel teasing of the schoolmates. Faizaan visited him last week, and promised him that he will take care of the teasing issue. But, I never imagined he would sacrifice his lovely hair for the sake of my son! Sir, you and your wife are blessed to have such a noble soul as your son. I stood transfixed. And then, I wept. 'My little Angel, you are teaching me how self-less real love is!'
